Terms & Conditions

Please read the following information carefully before placing an order with us. Our terms and conditions apply to all purchases made by ‘you’, the customer, from us: Eley Kishimoto Apparel Ltd (‘EKA Ltd’).

Selling takes place exclusively subject to the following terms and conditions. Variations, particularly oral subsidiary agreements, are only valid if we have given written confirmation of them.

REGISTRATION

When ordering products from www.eleykishimoto.com/shop you may decide whether or not to register. We would encourage you to register as this makes ordering from our site in the future quicker and easier as we can retain your details. This will also enable you to store items in your shopping basket should you be unable to complete a transaction at any particular time*.

UK customers may make purchases without registering. However, for security reasons, we would request that international customers be registered with us before making purchases.

At registration you may opt to receive news, offers, products and services from us via email. If you want to receive this information, please indicate this by ticking the ‘I would like to receive news…’ box on the registration form.

You may sign up for news, offers, products and services from us without making a purchase from the online store.

If you register or sign up for news with us, and later decide you wish to cancel registration or news sign up, please email: shop@eleykishimoto.com and write ‘Cancellation of registration’ or ‘Cancellation of news’ as the subject. In the body of the email please state your name, email address used for registration, and telephone number (in case we need to contact you regarding cancellation and especially if this differs from the information you originally supplied.)

*The shopping basket retains details of products only. Items are not removed from stock and remain available to purchase until payment is completed. To avoid disappointment, we would advise you to make payment as swiftly as possible. Should product(s) become out of stock whilst in your shopping basket, or there are any changes to the product listing (specifically price), you will be informed at the checkout and no payment will be taken.

 

ORDER PROCESSING

Orders placed outside of working hours (Monday-Friday 10am-5.30pm GMT, excluding weekends and public holidays) will be processed as soon as possible, usually within 2 working days.

All orders are binding on you, the buyer. If there is a problem with your order, including non-availability of any in-stock item(s) you will be contacted as soon as possible, usually within 2 working days. If you do not reply to a query within 5 working days, your order may be cancelled. EKA Ltd reserves the right to issue counter notices and cancel orders at our own discretion. In the case of cancellation on our part, we will issue a full refund.

For non stock item(s), Forward order or Made to Order items, if the delivery date exceeds that stated at time of placing the order, EKA Ltd will contact you as soon as possible before the delivery due date. In this case we reserve the right to extend delivery by a reasonable length of time. If the delay in delivery exceeds 2 months, then you are entitled to withdraw from the contract and we will issue a full refund. In the case of force major and other extraordinary circumstances beyond our control, and we are prevented from fulfilling you order, we will be released from our liability and will issue a full refund.

Prices

The prices listed on www.eleykishimoto.com/shop remain valid until revocation. Although we endeavour to keep prices correct, we reserve the right to alter or adjust them at any given time at our discretion.

Products are listed and sold excluding delivery and you will cover shipping costs.

All prices include VAT where applicable. VAT will be charged on all purchases. We do not offer tax-free shopping for customers outside the EU.

Refund Processing

Refunds will not be processed until returned items are received, inspected and authorised. Refunds will be processed as quickly as possible, usually within 3 working days from our receipt. Further time should be allowed for clearing into your account, as this will depend on the original method of payment. Refunds will only be made to original account/method of payment. We do not offer store credit.

Postage/ delivery refunds will be issued at cost, up to a maximum of the original delivery cost charged from EKA Ltd at first dispatch. Although we advise items are returned using a signed for service, we cannot accept any claims for express or unorthodox return charges or methods.

 

VARIATIONS

EKA Ltd guarantees all products for sale at www.eleykishimoto.com/shop to be free from defects of workmanship. All items are inspected upon listing and before shipment.

Many of our products are manufactured by hand or employing traditional production methods so there may be slight variations, in quality, colour, shape, finishing, width, weight, design and fittings, which are technically unavoidable.

Any irregularities in fabrics or prints are characteristic of the manufacturing process, and are an integral part of the design.’

These variations do not result in claims for patent defects.

We aim to offer true colour representation. However, due to the nature of online shopping we can not be held responsible for any variations of colour as shown on screens, monitors or printouts.

 

RETURNS AND EXCHANGES

EKA Ltd offers a returns service for unwanted items, including changes of mind. We will happily offer a full refund or exchange on defective products. Where shipped products differ from those ordered a full refund or exchange will be made.

Limits and exceptions

All returned non-defective item(s) must be received within 14 days from our despatch date.

All returned non-defective item(s) must be unworn with all tags and labels still attached and sent back in the original packaging and with the original documentation. Items that have been used or worn, laundered, or altered in any way, will not be accepted for return or exchange.

Items purchased from www.eleykishimoto.com/shop cannot be exchanged or returned at any retail outlets selling Eley Kishimoto products, and must be returned to EKA Ltd returns department only.

For hygiene reasons, hosiery, lingerie, swimwear, cosmetic and grooming products cannot be returned unless defective.

‘One Offs’ and items in the ‘Bric-A-Brac’ section of the store are sold ‘as described’ and in some instances will be vintage and/ or used. In these cases please see each individual item description for returns policy. In some cases these items will be noted as ‘non-returnable’.

‘Forward Order’, ‘Made to Order’ or 'Printed to Order' items will be produced specifically for you. Pre-payment upon order will be required. These orders cannot be cancelled and items cannot be returned unless defective.

How to return an item

If you want to return or exchange an item, please contact us as soon as possible via email or telephone. You will be issued with a Returns Reference Number (RRN). Please record the RRN on the returns form (printed on original delivery note/invoice).

For all returns (other than defective items) original documentation must be enclosed, this is the original delivery note and returns form. Please provide a brief reason for your dissatisfaction in the appropriate space on the returns form.

For the return of all defective items, you must inform us immediately (within 2 working days of receipt) of the fault/damage. You must specify the defects when requesting your RRN and proof of purchase must be provided.

Please ensure all item(s) are returned using suitable packaging. You are responsible for arranging return shipping. EKA Ltd strongly advise that you use a traceable, signed for, or courier service (such as Royal Mail Signed For or Special Delivery or UPS/ DHL etc), as we cannot be held responsible for items lost in transit. Items are not considered returned until received by us.

Unwanted items

EKA Ltd will gladly refund or replace any item you are not completely happy with. If you are unsatisfied with the fit or size of an item, you may exchange it for the same item in another size. Please indicate the required size for your replacement item on the returns form. In this instance, you will cover return postage. However, if a replacement item is required and is in stock, we will cover the cost of redelivery. If you want to return an item for any other reason, including changes of mind, you will cover the return postage. If you wish to exchange for a different product we will issue a refund less the original postage charges, and a new order must be placed.

Patent defective products (defective workmanship)

In the unlikely event of defective products being shipped, we will issue a full refund, including postage and return postage. If a replacement item is required and is available/ in stock, we will refund postage and return postage and we will also cover the postage costs for the replacement item.

Defective products (damaged in transit)

All items shipped by and from EKA Ltd, will require a signature upon receipt. If the packaging is damaged in any way, especially if the product(s) inside have also been damaged, you must indicate this to the delivery person and note this with your signature when asked to sign. In this case, we will issue a full refund, including postage and return postage. If a replacement item is required and is available/ in stock, we will refund return postage and we will also cover the postage costs for the replacement item.

Unsuitable items returned for refund outside of 14 days from dispatch date, will not be refunded. If you return items that are not eligible for refund (please see limitations) it is your responsibility to arrange redelivery, and EKA Ltd reserve the right to dispose of all unclaimed items within 14 days. However, redelivery may be arranged by EKA Ltd at the products standard delivery charge plus an additional 50% administration charge. This service is offered at our own discretion and has no time limit attached to it. Goods may not be collected in person.

This dos not affect your statutory rights.

 

SHIPPING

All orders will be shipped from London, England. All shipping costs will be calculated by weight and shipping territory. Products are listed and sold excluding delivery and you will cover shipping costs. EKA Ltd will ship to the following territories/ zones:

 

  • Locally: United Kingdom

  • Within Europe: Austria, Belgium, Czech Republic, Denmark, Finland, France, Germany, Gibraltar, Ireland, Italy, Netherlands, Norway, Poland, Portugal, Romania, Russia, Spain, Slovakia, Slovenia, Sweden, Switzerland, Tunisia, Turkey, Ukraine, Uruguay

  • Internationally: Australia, Canada, Hong Kong, New Zealand, Republic of Korea, Thailand, United States of America

Most parcels will be sent using a Royal Mail service requiring a signature, but EKA Ltd reserve the right to use another shipper at our own discretion. However, all shipments will require a signature upon delivery.

For domestic (UK deliveries) for all first time orders, we will only ship to the cardholders/ account address. We will ship to an alternative address (e.g. work address) for registered, returning customers only. Please ensure you provide contact details and add a note at checkout if requesting an alternative delivery address. We will endeavour to respond to your enquiry within 2 working days. All alternative delivery address requests must be verified by EKA Ltd, and we may ask for additional information to that provided at registration. Failure to provide sufficient contact details may result in a delayed dispatch of your item(s) or refusal to ship to an alternative address.

For all international deliveries, you must be registered with EKA Ltd. Orders must be delivered to the cardholders/ account address. Unfortunately we are currently unable to ship to an alternative international address.

If your territory is outside those listed that we will ship to, please make a phone or email enquiry in advance of making a purchase. We will endeavour to respond to your enquiry within 2 working days and we may be able to authorise a shipment to you.

Deliveries outside of the EU may be subject to import duties and taxes that are levied once a package reaches your country. You will be liable for such charges. EKA Ltd cannot predict what they may be and have no control over them. Please contact your local customs office if you require further information.

Please note for security reasons we cannot ship to Post Office Boxes.

We reserve the right, without reason, to refuse to ship for any reason and to any territory. In the event of an order cancellation by us, we will refund any payments taken.

Most in-stock orders will be dispatched within 5 working days, but we endeavour to despatch within 2 working days. Your order should arrive within 10 working days. Delivery times cannot be guaranteed and are quoted from despatch date, not order date. The delivery time itself is considered as met, if by the end of the stated delivery time, the order has been dispatched.

Unfortunately we are unable to provide customer tracking for orders.

If you are returning item(s) to us, please ensure they are returned using suitable packaging. You are responsible for arranging return shipping. All returned items are shipped at your risk until received by EKA Ltd. EKA Ltd is not responsible for any damage or loss of items whilst in return transit. This is regardless of whether return postage is paid by you or EKA Ltd.

EKA Ltd strongly advise that you use a traceable, signed for, or courier service (such as Royal Mail ‘Signed For’ or ‘Special Delivery’ or UPS/ DHL etc.

Items are not considered returned until received by us.

 

PRIVACY POLICY

Eley Kishimoto Apparel Ltd is committed to protecting your privacy and security. When you register with us, we ask for your name, email address, postal/home address and telephone number. If you place an order with us, we will also ask for your credit/debit card details. In accordance with the Data Protection Act 1998, Eley Kishimoto Apparel Ltd will not pass to any other body confidential information and details except where necessary for the processing of your order. However a record may be kept solely for the use of Eley Kishimoto Apparel Ltd. Your data will only be stored and processed in the UK.

No payment details such as credit or debit card information are retained by EKA Ltd .

We reserve the right to disclose your details to comply with applicable laws and lawful government requests or requests by the police investigating suspected illegal activities, to operate our systems properly and to protect other users and ourselves.
